1. Acceptance of These Terms

By visiting or using the Site, you agree to these Terms, to our Privacy Policy, to our Cookies Policy, and to our Disclaimer, all of which are incorporated here by reference. If you do not agree, please do not use the Site; you are always welcome to call the office at (404) 446-2776 instead.

You must be at least 18 years old to submit information through the Site. A parent or legal guardian should contact the office by phone to arrange care for a minor.

2. The Site Is Information Only

The Site describes our practice, our team, and the dental services we offer. It is general information, not dental or medical advice, and using it does not create a dentist–patient or doctor–patient relationship between you and Dr. Sharifa Walker, DDS or anyone else at the practice. That relationship begins only when you are examined and accepted for care at our office in Decatur. Our full Disclaimer sets this out in detail.

Never delay seeking professional care, and never disregard advice you have already received from a licensed dentist or physician, because of something you read on the Site.

3. Appointment Requests, and Emergencies

A form submission is a request, not a booked appointment. The contact form sends us a message. Your appointment exists only after a member of our team confirms a specific date and time with you by phone, text, email, or in the patient portal. We are a small practice; forms are reviewed during office hours and we aim to respond within one business day.

Do not use the Site for a dental emergency. If you have uncontrolled bleeding, significant swelling, difficulty breathing or swallowing, a facial injury, or severe pain, call us immediately at (404) 446-2776, or call 911 or go to the nearest emergency room if the situation is urgent. We hold same-day emergency appointments daily, but we cannot see a request that arrives by web form outside office hours.

4. What You Send Us

The Site’s forms are ordinary web forms and are not a secure channel for health information. Please do not submit medical or health details, insurance or account numbers, Social Security numbers, or anything else you consider confidential. Information you send through the Site is not entered into your protected dental record. See Section 3 of our Privacy Policy for how we handle it and how long we keep it.

By submitting a form, you confirm that the information you give is accurate and that you are authorized to provide it. If you subscribe to our newsletter, you consent to receiving practice news and updates by email and may unsubscribe from any message. If you give us a mobile number, our text messaging terms are in Section 4 of the Privacy Policy.

You keep ownership of what you send us. You grant us a limited right to use it for the purpose you sent it — answering your question, arranging care, or sending the emails you asked for. We will not publish anything you send us, or use your name, photograph, or words in marketing, without your separate written permission.

5. Our Content and Trademarks

Except where noted, the text, photography, design, layout, and code of the Site are owned by Better Health Dental II, LLC or used under license, and are protected by copyright and other laws. “Better Health Dental” and our logo are our marks. You may view, print, and share pages of the Site for your own personal, non-commercial use. You may not copy, republish, scrape, mirror, sell, or build a derivative work from the Site, or use our name, marks, or photography, without our prior written consent.

Third-party names and marks that appear on the Site — including EMFACE and BTL Aesthetics, Curve Dental, Sunbit, and CareCredit — belong to their respective owners and are used to identify those products and services, not to claim any ownership or endorsement.

Clinical photography. The before-and-after images on our EMFACE page are supplied by the device manufacturer and by other treating physicians, with permission and with the credit shown beneath each image. They are not photographs of Better Health Dental patients, and they are not a representation of the result any individual patient will achieve.

6. Acceptable Use

You agree not to:

• Use the Site for any unlawful purpose, or in violation of these Terms
• Submit false, misleading, or impersonating information, or another person’s information without their permission
• Send spam, bulk messages, advertising, or solicitations through our forms
• Attempt to gain unauthorized access to the Site, our private team pages, our accounts, or any system or network connected to them
• Probe, scan, overload, or interfere with the Site or the servers that deliver it, or introduce malicious code
• Harvest email addresses, phone numbers, or other data from the Site by automated means
• Remove, obscure, or alter any copyright, credit, trademark, or other proprietary notice

We may restrict or block access to the Site at any time if we reasonably believe this section has been violated.

7. Third-Party Links and Services

The Site links to services we do not control, including our patient portal hosted by Curve Dental, the financing applications of Sunbit and CareCredit, our job listings on Gusto, our social media profiles, and community and professional resources. Those links are offered for convenience. We do not control, endorse, or take responsibility for the content, terms, availability, or privacy practices of any third-party service, and once you leave the Site these Terms no longer apply.

Patient financing. Sunbit and CareCredit are independent lenders. Approval, credit terms, interest, and fees are set by them, not by us, and we receive no part of the interest or finance charge. Any estimate of cost, insurance benefit, or monthly payment shown or discussed anywhere on the Site is an estimate only and is not a quote, a guarantee of coverage, or a binding price.

8. Availability of the Site

We try to keep the Site available and accurate, but we do not promise that it will be uninterrupted, error-free, or current at every moment. We may change, suspend, or discontinue any part of the Site, including any page, feature, or service description, at any time and without notice. Prices, service offerings, hours, and team members can change.

9. Disclaimer of Warranties

The Site and the Services are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. To the maximum extent permitted by applicable law, we disclaim all implied warranties, including the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty that the Site will be secure, uninterrupted, accurate, complete, or free of viruses or other harmful components.

This section is about the website. It does not disclaim, limit, or alter the standard of care we owe you as a dental patient, or any warranty or obligation that cannot be disclaimed under applicable law.

10. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Better Health Dental II, LLC or its owners, officers, employees, contractors, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Site or Services. In no event shall Better Health Dental II, LLC’s total liability for all claims arising out of or related to these Terms, the Site, or the Services exceed the greater of the amount you paid to Better Health Dental II, LLC in the twelve (12) months preceding the event giving rise to the claim or one hundred dollars ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so parts of this section may not apply to you. This section applies to your use of the website and does not limit any liability arising from the dental care we provide, or any liability that cannot be limited under applicable law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Better Health Dental II, LLC and its owners, officers, employees, contractors, and agents from and against any and all claims, demands, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to: (a) your use of the Site or Services; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) your violation of any right of a third party, including through any content you submit.

12. Governing Law and Venue

These Terms, and any dispute arising out of or related to them or the Site, are governed by the laws of the State of Georgia, without regard to its conflict-of-law principles. Any such dispute shall be brought exclusively in the state or federal courts located in DeKalb County, Georgia, and you consent to the personal jurisdiction of those courts.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we revise the Effective Date and Last Updated date at the top of this page, and the updated Terms take effect when posted. Continuing to use the Site after that means you accept the change. Please check this page periodically.

14. General

Severability. If any provision of these Terms is held unenforceable, that provision will be limited or removed to the minimum extent necessary and the rest will remain in full force.

No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.

Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of the practice’s assets.

Entire agreement. These Terms, together with the Privacy Policy, Cookies Policy, and Disclaimer, are the entire agreement between you and us concerning the Site. They do not replace or modify any treatment consent, financial policy, HIPAA acknowledgment, or other document you sign as a patient of the practice; if a signed patient document conflicts with these Terms on a matter of your care, the signed document controls.
